Service Animal Suit Dismissed, Revived
The Ninth Circuit Court reversed a decision favoring a landlord who had rejected a prospective tenant’s application because they had a service dog. The prospective tenant had filed a discrimination suit, alleging that the landlord had violated both the federal Fair Housing Act and California’s Fair Housing and Employment Act, and claiming negligence. This followed the denial of the group application, which included a request to accommodate the plaintiff’s service animal, a 50-lb. terrier mix named Tinkerbell. The rental advertisement had stated a “No Dogs” policy, but the plaintiff had explained that Tinkerbell was a verified support animal and a “reasonable accommodation” under the Americans with Disabilities Act.
