State Law Change Impacts Water Rights in Certain Parts of Idaho

Helping a Buyer or Seller purchase or sell a property with a well? Or does the property use a community well?

Is the property in a ground water management area?

Did you know Idaho law changed July 1, 2025 and the changes could mean the property cannot use well water for irrigation including water for the properties lawn? The new law requires a sperate water right in critical ground water management areas for traditional uses like irrigating a lawn.

IR is working with IDWR, water users, and legislators to fix problems under the new law and clarify existing wells are not implicated by future changes.
